Free Business Credit Score Terms and Conditions

Free Business Credit Score Terms and Conditions is subject to the following Terms and Conditions (“Terms and Conditions”) for participation in OnDeck’s Free Business Credit Score program (“Free Business Credit Score”), which may be amended from time to time at the sole discretion of OnDeck. You must accept these terms and conditions in order to participate in Free Business Credit Score.

“You” means the individual who filled out the form on the OnDeck website to obtain a free business credit score and also the business entity for which OnDeck is obtaining business credit scores.

For purposes of these Terms and Conditions, “OnDeck” includes ODK Capital, LLC, On Deck Capital, Inc., and other affiliated companies, and their subsidiaries, employees, agents, and service providers of ODK Capital, LLC.

Terms of Use and Privacy Policy

To register with OnDeck for a free business credit score, you must be located in the United States, possess a valid tax identification number, and agree to OnDeck’s Terms of Use, Privacy Policy, and these specific Terms and Conditions. Free business credit scores are not available for sole proprietorships or general partnerships. OnDeck reserves the right to cancel your registration at any time and for any reason. Additionally, OnDeck may be unable to provide a business credit score if there is limited or no available business credit bureau data.

Marketing Consent

By providing your contact information to OnDeck to register to receive a free business credit score, you agree to receive marketing e-mails and other communications from OnDeck, including telemarketing calls and text messages at the telephone numbers provided when you registered your business for a free credit score. Such phone calls and text messages may be sent using an automatic telephone dialing system or an artificial or prerecorded voice. You agree that the contact information that you provided (including, but not limited to the business name, address, telephone number, and email address) is accurate for the identified business and business owner, and that you have authority to authorize that business to consent to the receipt of marketing emails, telephone calls, and text messages at the telephone numbers and email addresses that you provided.

You may opt-out of receiving text messages, telephone calls, and emails at any time by following the instructions provided in the communication (such as responding “Stop” to a text message or clicking the “unsubscribe” link on an email) or via any other method as provided for in OnDeck’s Privacy Policy. In the event that you opt out of receiving all marketing communications from OnDeck, you agree that OnDeck may cease providing you with the credit score information for your business in the future.

Consent for OnDeck to Obtain Credit Report Information

By providing OnDeck with your contact information and requesting that OnDeck provide you with a business credit score, you agree that you have provided OnDeck with written authorization to obtain the business credit score and other information for the business identified on the registration page, and that you have authority to provide such written authorization on behalf of the identified business. You agree that this constitutes written instructions for OnDeck to request and receive business credit scores under any state or federal law that may govern the use of business credit reports. You further agree that to the extent the information that OnDeck receives could constitute a consumer report under the Fair Credit Reporting Act (15 U.S.C. sec. 1681, et seq.), you are providing OnDeck with written instructions authorizing it to obtain that information under the Fair Credit Reporting Act and any related state law governing the use of consumer credit reports and have authority to make that request on behalf of the consumer to whom such information relates. You understand that OnDeck will use the information obtained from the business credit reporting agencies to offer you OnDeck products from time to time, and/or to pre-fill and facilitate applications for OnDeck products and services.

Release of Liability

You agree that OnDeck shall not be liable for any inaccuracy in the information provided to you through Free Business Credit Score. The business credit score provided through Free Business Credit Score will be provided to OnDeck from Equifax Information Services, LLC, or another third party entity selected by OnDeck that provides business credit scores, based on the information that you provide to OnDeck when registering for Free Business Credit Score. Equifax is not the sole entity that provides business credit scores, and other entities that provide such scores may use different information to calculate a score. The score provided to you is for informational and educational purposes only.

Class Action Waiver

Except as otherwise prohibited by applicable law, and subject to the arbitration clause in Section 16 of the Terms of Use, unless you and OnDeck agree otherwise, any lawsuit between you and OnDeck (including, but not limited to any employees, officers, agents, affiliates, successors, and assigns of OnDeck) relating in any way to your registration with OnDeck to receive business credit scores must be resolved on an individual basis only, and not as part of a class action or on a consolidated basis. Thus, neither you nor OnDeck may bring or participate in a class or consolidated action, either as a plaintiff, defendant, representative, or class member. This provision is not applicable to a class action settlement approved by a court.
